These Terms of Service ("Terms") govern your access to and use of the BuildMode mobile application and website (collectively, the "Service"), operated by BuildMode ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.
To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@buildmode.ai if you suspect unauthorized access to your account.
BuildMode provides an AI-powered behavior and adherence system designed to support fat loss and healthy habit formation. The Service includes daily check-ins, goal tracking, food and fasting logs, AI coaching conversations, weekly reviews, and community features.
Not medical advice. The Service is for informational and motivational purposes only. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making changes to your diet, exercise, or health regimen. BuildMode is not a substitute for professional medical care.
AI limitations. The AI coaching features are powered by large language models and may produce inaccurate, incomplete, or inappropriate responses. Do not rely solely on AI-generated content for health decisions.
BuildMode offers a free tier and a paid "Founder Access" subscription. Subscription details, including pricing, are displayed in the app at the time of purchase.
We may offer a free trial period for Founder Access. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. Trial eligibility and duration are determined at our discretion and may change at any time.
You retain ownership of any content you submit to the Service, including community posts, journal entries, and profile information ("User Content"). By submitting User Content, you grant BuildMode a non-exclusive, worldwide, royalty-free license to use, store, display, and process that content solely for the purpose of providing and improving the Service.
You agree not to submit User Content that:
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to the Service or its users.
The Founder Community feed is a private space for Founder members. You agree to engage respectfully and constructively. BuildMode is a behavior and adherence tool — community content should relate to your experience with the system. We reserve the right to remove posts and suspend or terminate accounts that violate community standards.

The Service and its original content, features, and functionality — including the BuildMode name, logo, app design, AI prompts, and coaching methodology — are owned by BuildMode and protected by applicable intellectual property laws. You may not use our intellectual property without our prior written consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDMODE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUILDMODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless BuildMode and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time from the More tab in the app. Upon termination, your right to use the Service ceases immediately.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction in the United States.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification through the app. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
